UCLA: Where 'Queer Studies' and Middle East Studies Meet

The University of California, Los Angeles (UCLA) Center for Near Eastern Studies (CNES) is a delightful contradiction of incompatible notions. On one hand, the professors take hard-left stances on sexuality and gender issues, claiming to staunchly support the rights of gays and women. Yet they also worship at the altar of radical Middle East studies professors who act as apologists for Sharia law and other policies completely at odds with Western "liberalism."

The UCLA Queer Studies Conference 2010, which took place on October 8-9 and counted CNES among its sponsors, was a case in point. The panel discussion I attended, along with all of fifteen people, was titled "Trans-lating the Middle East." Let me "trans-late" and save others the time of attending future UCLA conferences on the subject. Gays in the Middle East are persecuted. It really is that simple. But that didn't stop participants from engaging in the usual anti-Western, jargon-laden rhetoric.

Gil Hochberg, Vice Chair of Comparative Literature and LGBT Studies at UCLA, was the moderator. She decried the "heterosexualization of our culture" and the "heterosexist portrayal of politics." Homosexuality, she claimed, is an "erotic disorder exclusively as [sic] a white pathology like white racism ... fault, guilt, refusal of fault, and paranoia."

There is an "innate imperialism of gay rights movement, a white western women's movement," she continued. Gay Muslims are "acting out of economic necessity."

She asked, "Why has the West been so successful in imposing homosexuality on the Arab world?" and answered, "People are seduced by gayness and Americanism. Natives are informants of the white gay international, not true Arabs."

University of Southern California (USC) sociology professor Evren Savci spoke about "Bigudi: An Alternative Beginning." Her remarks were so scintillating that CNES director Susan Slyomovics briefly fell asleep. When Slyomovics snapped to it, she stated that she was having trouble hearing the professor. She wasn't the only one.

Savci's "research" consisted of "five weeks working as a gay bar person and four weeks pretending to be a bar client" and led her to conclude that "queer includes the butch feminine."

University of Austin Texas anthropology professor Sofian Merabet spoke "On the (Im)possibility of Queer Translatabilities and the Formation of Gender Identities in Post-Civil-War Beirut, Lebanon" -- whatever that means.

Merabet expounded at length about his "one subject, a 73-year-old man, a most eccentric fellow. He was stocky and had a hunch-backed physique. He had posters of martyrs of Hamas and Hezbollah. He was a devout Roman Catholic -- not a Christian supremacist, but a social elitist."

Merabet is not a statistician, so perhaps he did not know that observing one person -- whatever his religious proclivities -- does not constitute an adequate research sample size.

He described his subject as "a staunch Meditarraneanist," who "yearn[ed] for the Ottoman Empire to be restored."

Merabet then added, "We also climbed the stairs where the host sunbathed naked and hoped to relieve himself from a skin condition. He overtly showed his disappointment. We refused his ride home."

I closed my eyes in case there were visual aids.

Gay people are "living their lives on ambiguous margins," Merabet stated.

Well, yes -- Islamists are trying to murder them.

There was "a hint of Norman Bates in the air," he added.

One wonders if Merebet was talking about himself on this one. His remarks were a tad psychotic.

Continuing on in this vein, he noted that there was "a toilet seat filled with dollar bills he had purchased from New York City," and then opined, "In France, I feel Oriental."

Given that this was a conference sponsored by the LGBT community, some love for that community had to be forthcoming. What happened with gays?

"Muslims woke them up by asking them to leave their lazy lives behind unless they want to burn in hell," Merabet stated.

He ended by declaring homosexuals to be on the "ephemeral daily fringes of social behavior."

Next up was Oren Segal, a graduate student in the University of Michigan's Near Eastern Studies Department. His topic was "Returning to the Father's Land: Yotam Reuveny's Queer Nationalism."

Homosexuals are "sexual outlaws," he declared. We should "segregate all the queers, create an all-male society, a new independent state near Sodom."

More bizarre commentary followed:

"There are three types in the world ... men, women, homosexuals, and lesbians."

"If gay men will act like real men, straight men lose interest to persecute and subjugate them."

"Heterosexuals cannot stop hating homosexuals. They can only hide it. It is in their blood."

"The pride parade is a freak show to heterosexuals. Stop parading; go back to Sodom."

Segal then launched into a tirade involving homosexuality and Judaism:

"Homosexuality, like Judaism, is a race."

"Gays, like Jews with Zionism, need their own separate space. Gays need their own homeland."

"Stop hiding from false morals. Why are some homosexuals gayer than others and obsessed with sex?"

"Jews were compelled to be homosexuals to increase both types. Homosexuality is another case of Jewish deviance."

"Like gays ... be a Jew in your home and a man outside it."

"A Jew is a person who is considered by others to be a Jew. A homosexual is a person who[m] others consider to be one. It only exists as others define it."

Actually, a Jew is a person born to a Jewish mother.

Segal continued,

"Jews and homosexuals are too passive to found their own state."

"The Sodomite movement is similar to the Zionist movement."

Professor Slyomovics -- no fan of Israel -- laughed heartily at this remark.

"If Jews have a state where they are normalized, gays should have the same."

"Jews will always be outsiders in front of their fellow citizens, no matter how hard they assimilate. A real solution to the Jewish problem ... Homosexuals can first be put in ghettos and then put in concentration camps ... then they will never be safe without a territory and an army."

Segal then offered his fantasy:

"A new society formed out of the 2012 gay holocaust in the same way Israel was formed out of the Holocaust."

Despite five minutes for questions, there were none. since most of these professors spent the time talking to each other anyway, they simply continued.

When asked by another professor, "How do you define political?," Merabet replied, "The political share my agenda, the apolitical disagree with my agenda."

His honesty was refreshing.

Hochberg asked Segal about the future land of Gayistan: "Is this new nation sarcastic? Will there be Jews, Arabs, and Palestinian gays?"

Segal responded that it is "serious and parody. The founder is Israeli, Jewish, Arab -- and Palestinian gays all over are invited. Men only -- no lesbians."

Professor Slyomovics laughed again, since excluding women is a hysterically funny topic.

Segal concluded that "[t]he Gay Holocaust started in America. After the great war, Israel and Palestine don't exist anymore. A new state emerges. The state of Sodom emerges."

Slyomovics laughed loudly, barely containing herself. I could not tell if she was celebrating the eradication of Israel or is just pro-Sodom(y).

To top off the absurdity of it all, the conference ended with a music performance by a woman named Vaginal Davis.

I'll leave that one to the imagination.

You find yourself standing in a crowded area (downtown at rush hour, the airport during the holiday season to see your loved ones, the subway) with people routinely bumping each other shoulder to shoulder without any sense of personal space. This is my bubble and you stay out of it! There doesn't seem to be any real order here or malicious intent; only controlled chaos like a colony of bees swarming in and around its hive. (No offense to bees but I've never heard one say, "Excuse me".)

Through the bustle you see Him. Anxiety strikes you, yet you try to appear calm. You look around to see if anyone else can see Him and if so, do they seem to be as nervous as you are. Is it getting warm in here? You seem to have begun perspiring a bit. Please, not today. I just wanted to...fill in your action here. He seems to look a bit nervous as well. You can see it in His eyes. This can't be good. Perhaps this exact spot isn't where you need to be standing right now. You struggle to turn in the crowd. "Excuse me. Ex-excuse me, please." That's a good child, polite until death. You don't take your eyes off him. He begins to gaze over the crowd. His lips move methodically as if he were saying the same thing over and over again. Though it isn't English, you recognize it. His facial expression is no longer nervous; perhaps he has found some sort of resolution. He cracks the slightest grin as he looks over the crowd; the chant continues. Suddenly the smile fades as his teeth begin to snarl his brow falls and his eyes gleam as that of an Islamic Warrior. He grabs for the zipper of his worn leather jacket. The jacket is unzipped and falls to the floor. You realize that you do recognize what he is saying; it is now audible.

"ALLAH AKBAR!" he is now yelling. Wait a second. You mean they really say that stuff in real life? Cool! Time stops as this Middle Eastern man stands amongst the crowd in his galabiyya and suicide vest ensemble. Where's the Fashion Police when you really need them? You push with all of your strength now against the hustle. Turn damn it! Turn now or die! The first thing that comes to your mind slips out of your mouth. Well there goes the, "Polite until death," compliment I just gave you. Now if you live through this, remind me to wash your mouth out with soap!" The sound of the explosion is deafening; you feel the sound penetrate through your very being. Still alive! As you regain your wits, screams are all that can be heard. The hearing in your left ear has obviously been tinkered with.

Your spirits begin fall as you surrender to the reality of the current tragedy. Your legs (it seems like everyone else's) are pumping like pistons involuntarily. To your right you see a well built man running alongside you with a little boy in his arms. "Daddy, why did the man blow up?"

So when you hear someone saying, "My name is... (insert popular Arabic/ Middle Eastern name here)," what do lots of Americans think?

"But when I get on a plane - I gotta tell you - if I see people who are in Muslim garb and I think - you know - they are identifying them self first and foremost as Muslims. I get worried. I get nervous." - Juan Williams

Still not convinced? No, my good boy. What exactly is your point? There was even a story on Fox News speaking of a poll conducted that stated 1 in 5 Americans believe President Barrack Obama is Muslim (as if such a finding lowers his potential to be a credible American President).

My point is quite simple. American society through its experience and fear of terrorist attacks has painted a picture that all Muslims and people with Middle Eastern features are suspects.

But wait - I'm Hindu!

Sorry buddy, how 'bout for now you go stand over there with the rest of the Middle Easterners.

Perhaps we should take the time to notice the path of our country's mind set when we have an American Preacher declaring observances such as "International 'Burn a Quran' Day". Terry Jones at one point stated that, "The message," (of burning Qurans as a national observance to the ninth anniversary of 9/11), "we are trying to send is much more important than people being offended." Was his controversial fifteen minutes of fame a bunch of farfetched bull? Or was he simply the only one with enough courage to express a concept that so many Americans had already internalized?

So I guess the question would be, "Do good Muslims feel uncomfortable in our society at all?"

Of course not; this is America for God's sake, the Land of Opportunity. Right?

This is the part in Escaping the Box where your opinion matters. Let's see what it is you have to say about it. Have Muslims in America become second class citizens? Muslims as a second class citizen. What a joke. Muslims are getting their way in most anything they want. And Muslims are the main problem they may consider themselves second class. Its Muslims thats sent those packages on planes this weekend. Al-qaida are Muslims. Lets get that facts straight first. Call them whatever else you want, but they are Muslims. Panty bomber, a Muslim, Ft. Hood Killer, a Muslim, Not since Timothy McVeigh has there been any major terrorist threats by White Christians. Every week if you take time to do your research we find more Muslims, many of them homegrown Jihadi's that are looking to kill Americans.

And its not just Islam, Muslims want to bring Sharia law to this country. We see it happening all over Europe. Islam isnt Islam without Sharia. You can't deny that. Sharia means its ok to Murder your daughter if she leaves Islam. Its ok to beat your wife cause the Quran says its ok. Sharia means its ok to dig a hole and bury a women up to her shoulders and stone her to death for adultery. Its Sharia that says gays should be hanged.

In Oklahoma, theres on the ballot now asking citizens to vote if they want Sharia or no Sharia allowed in the courts in that state. Already Muslims are complaining its another sign of Islamophobia. Its the same anytime I or someone else speaks out against the evils of Sharia and Islam itself.

Why is it that no other religions are allow in Saudi Arabia? Bibles are burned or trashed everyday in Saudi Arabia. No one entering the country is allowed to bring their bible, and if they do, it is confiscated and burned or trashed. Thats a fact. Non muslim are not allowed in Mecca, talk about second class citizens. Islam is good at that.

If Muslims want to feel more welcome in my country, yes I said my country, then they should try to coexist as Americans and not want to remain confined to their Islamic beliefs. Its why Muslims have not been able to coexist with the citizens of europe. Muslims block the streets in many parts of Europe to pray. They are doing that here in this country. Dhimmi Bloomberg says Muslims have a right to block the streets. let Christians or other faiths try that sometime. It won't be allowed. Bloomberg has business in the Middle East, he's selling america out for the dinar.

So claiming that Muslims are second class is a joke. At the work place, Muslims are asking for special priviliges to pray or eat that no others ask for or get.

My advice to Muslims, is try becoming Americans first, Muslims second. Stop thumbing your noses at the millions of Americans that oppose the Ground Zero Mosque. We know its a victory Mosque. Its What Muslims have done all through history wherever they have conquered.

Muslim Obama claims to be a christian. Thats another of his taqiyya lies. This week he will travel to Indonesia and India. He plans to attend a service at a Mosque in Indonesia, but won't spend time in an Indian temple? Wouldn't want to upset the Muslims now would he? Obama spent years listening to hate speech by his preacher Rev. Wright. Yet Obama claims he didn't hear any hate speech. And speaking about hate speech, CAIR and other Islamic organizations want to impose hate speech here in America. Geert wilder is being tried for hate speech for speaking the truth about Muslims in Europe. Muslims are ok with calling for the death of Wilder. Muslims want to take away our 1st amendment. Politicians have caved into the demands of Muslims in Europe and we see that starting to happen here in America. Its time to put a stop to that now before America ends up with the same problems they are having in Europe. America is a Christian Country. I for one will not accept Islam and Sharia here as part of my country. If that makes me Islamaphobic, then so be it. Its up to Muslims to try becoming more American then asking Americans to become Muslims.

I guess I could have continued writing much more because there is much more to write. I can understand why a Hindu might feel bad if he is pulled aside if a Muslim Jihadi blows himself up in a crowed airport but then what would you expect the authorities to do? Let all Muslim looking folks continue on their way. Profiling is needed if we are to prevent further acts of terrorism by Muslims. Is a sad fact but true. Muslims did kill Americans on 9/11.  Major Hasan did yell Alah Akbar while murding 13 American servicemen and women and wounding 30 others.

Below is the speech given at today’s demonstration at Generatorstraat in Amsterdam by the British author and former Parliamentary candidate Paul Weston.

Hello. My name is Paul Weston, and I represent the International Free Press Society.

And I am standing here today because our liberal elites have betrayed our countries to Islam.

Forty-two years ago the British politician Enoch Powell made his famous “Rivers of Blood” speech, in which he stated that “The supreme function of statesmanship is to provide against preventable evils.”

Our politicians today do the exact opposite. They actively promote a preventable evil.

But eighty years ago one man, Winston Churchill, was very clear about preventing a clear and present evil, Herr Hitler and the Nazis. But Churchill was a lone voice crying in the wind of appeasement, and the carnage that could have been avoided came with a vengeance.

And today Europe finds itself in much the same position. Even as Islam grows demographically, territorially, and militantly, it is promoted as the “religion of peace” by the same type of cowardly, careerist politicians who once appeased Hitler.

Islam was not the religion of peace to Winston Churchill. He described it as the religion of blood and war.

Anyone with a knowledge of the foundations and history of Islamic expansion knows this to be the truth.

Mohammed was a warlord. And a very good warlord indeed. By the time of his death he had militarily defeated and converted most of the pagan and Christian tribes of the Arabian Peninsula.

After his death Islam rapidly expanded at the point of a sword, defeating ancient civilisations and overrunning continents as it did so.

And today it is within Europe, it is within the West, and it is calling for what it has always called for: total Islamic domination. And if we wish to resist, then they will use terror against us.

Yet still our treasonous politicians call it the “religion of peace”, and tell us that if we refuse to share such a fantastical and ridiculous notion, that if we choose to believe Winston Churchill’s argument that Islam is a religion of blood and war, then we will be sent to prison.

Of course it is not a religion of peace. Its founder was a warrior, and the highest honour bestowed upon a Muslim is the promise of hordes of scented houris and an eternal leg-over in the after life, achievable not by being a good Samaritan, but by dying as a martyr in the physical battle to expand imperialist Islam.

Islam literally means submission. What kind of a religion can possibly call itself submission?

Islam divides the world into two spheres. The House of Islam (submission) and the House of War. What kind of religion defines itself by military conquest?

Yet our leaders tell us we cannot criticise Islam because it is a religion, whilst the organisation of the Islamicconference, in cahoots with the united nations is striving to make any criticism of Islam illegal.

But Islam is so much more than just a religion. It is a political, social, legal and structural blueprint which totally dominates a devout Muslim’s life, and wishes coincidentally to dominate all devout non-Muslims’ lives as well.

It is profoundly illiberal and it is profoundly undemocratic. It does not believe in the man-made laws of democracy, preferring instead to adhere to the absolute word of Allah, as interpreted by an illiterate 7th-century desert dweller.

And our politicians have imported this illiberal and undemocratic ideology into the liberal democracies than make up the West, and then they dare to criminalise us when we object to this!

But how can we not criticise Islam? Can our politicians really protect it as a religion and therefore place it out of legal reach?

When homosexuals are hung from cranes, is this political Islam in action or religious Islam?

When adulterous women are buried up to their shoulders in sand and stoned to death, is this political Islam or religious Islam?

When Muslims who wish to leave Islam are issued with death sentences, is this political Islam, or is this religious Islam?

When wives and daughters are slaughtered to protect their families’ honour by husbands fathers and uncles, is this political Islam or religious Islam?

If it is political, then it must be denounced as evil and barbaric. If it religious, how can it possibly not be denounced as the same? What is evil is evil and what is barbaric is barbaric and cannot be exempted from criticism because it is sheltered by the word “religion”.

In criminalising free speech, our socialist leaders reveal their dictatorial ambition. The mark of a free society is freedom of speech. To take this away is a totalitarian act, made all the worse because freedom of speech is our only defence in the peaceful opposition against the foreign totalitarian ideology of Islam.

And I hope this irony is not lost on you. In order to protect and advance a foreign totalitarian ideology, our own rulers are prepared to adopt native totalitarian means to stop us defending our democracy and our freedom.

The West lives in accordance with the European Convention on Human Rights. Islam does not. They signed up instead to the Cairo Declaration on Human Rights in Islam.

But they have a very important caveat: when sharia law collides with human rights law, guess which law prevails?

Quite so. Sharia is the top trumps when it comes to human rights.

This is like a signatory to the Geneva convention murdering and torturing prisoners of war, and being given a pass at a war trial because it was “part of their religion.”

And when our politicians today excuse Islam as a religion of peace and allow them to set the rules both at home, at the European Union, and at the United Nations, then our politicians are betraying their countries and they are betraying their people. They are committing treason.

“Can one commit treason in a time of peace?” people may ask. But are we really at peace?

We may not consider ourselves at war with Islam, but Islam considers itself at war with us.

And it is a war we are losing. Territorially, demographically, politically, and democratically.

In fact, it is a war of aggression on two fronts. Radical Islam on the one, and left-wing treason on the other.

Our children are told to celebrate multiculturalism and Islam, without being told the real history of violent expansionist Islam.

Instead, they are told that their own history, their religion, their culture, their traditions, their very being, is just a litany of imperialism, racism, murder and slavery. This is a proven psychological technique designed to render an enemy helpless, or to quote Alexander Solzhenitsyn, “in order to destroy a people, you must first sever their roots.”

Any government that does this to its own people, to its own children, is a government that deserves, manifestly deserves, to be overthrown.

Can anyone really argue that a government that praises the foreign invader whilst psychologically and legally stripping away the defences of its people is a government that is not guilty of treason?

Now here we come to a more uplifting part of this depressing monologue, because in this part of the battle we are advancing. Slowly, admittedly, but relentlessly, and I think we are now unstoppable.

Geert Wilders here in the Netherlands, René Stadtkewitz in Germany, whose immediate popularity caused Angela Merkel to make an abrupt U-turn and denounce Multiculturalism.

The Sweden Democrats, Heinz-Christian Strache in Austria, the Swiss People’s Party, and in England we await a political movement to pick up the baton from the rapidly growing English Defence League.

And that growth can only accelerate. As more and more people become aware of Islam and become aware of the depth of treason perpetrated by their liberal rulers, and most importantly, as people lose their fear of being labelled a racist — which was a label specifically designed to strip us of resistance against a racially designated invader who uses race as a weapon.

In fact, let us deal with this “racist” label right now. It is not racist to defend your country against an obvious and growing threat. It is not racist to defend your culture, your heritage, and your traditions. It is not racist to work to ensure a democratic future for your children and grandchildren.

If you choose not to defend your country, your culture and the democratic future of your children, then you may well pat yourselves on the back in your non-racist champagne socialist cocktail bars in Islington; you may well love other people’s anti-racist credentials almost as much as you love your own; but there is no getting away from the label I have for you.

You are a traitor and a betrayer of your country, a betrayer of your culture, and a betrayer of our yet unborn children.

And you are a racist, indeed a genocidal racist. Young native Europeans will become a demographic ethnic minority within their own homelands if immigration rates and birth rates stay the way they are for just one more generation.

This can politely be called population replacement. More crudely, it is bloodless genocide.

The United Nations is very clear on this. Their definition of genocide is as follows. Quote.

Article 2.

In the present convention genocide means any of the acts committed with intent to destroy, in whole or in part, a national, racial or religious group.

We have been betrayed.

And one of the saddest aspects of this betrayal is the effect it has had on those old ex-warriors who fought for their countries in recent living memory.

Ex-Spitfire pilot Alex Henshaw died three years ago. He was acutely aware of the political betrayal of his country. He said:

“I feel extreme emotional sadness for the young men I knew that gave their lives willingly for a cause in which we all believed. And I often say to myself that if those young boys would come down now and walk through the villages, through the towns and through the cities and look around and see what is happening to us, they would say somewhere along the line we have been betrayed.”

Yes, Mr. Henshaw, I am afraid you have, and all of you socialist/liberal/left-wing people need to know what you have done.

You need to take a walk around your cities, towns and villages, take a look at the hundreds of thousand of graves standing as testament to the ultimate sacrifice made by our young men in order that you may live in a liberal democracy today.

You need to understand that this a not just betrayal, but a triple betrayal:

•The betrayal of all our old soldiers whose sacrifice granted us freedom,

•The betrayal of my generation who you threaten to imprison if we defend our inherited freedom, and

•The betrayal of our yet unborn, who, unless we stop it seem set to inherit a country racked with tribal and religious hatred, which must inevitably lead to a continental scale multicultural war that will make the break-up of Yugoslavia look like a bun-fight.

And, of course, it is also the betrayal of freedom and democracy.

Because freedom and democracy did not just magically appear. They evolved over two and a half thousand years, rooted in Greco-Roman Judeo-Christian ancestry. And were fought for and defended with much blood and sacrifice.

Democracy and freedom are not the personal possessions of socialist politicians to be handed away, without our agreement, to the descendants of a 7th century desert warlord, who view our attachment to democracy as just a weakness to be used against us.

I do not blame Islam. Fundamentalist Muslims are just doing what it says in the book.

But I do blame our politicians. There are two sides in this civilisational stand-off, and our politicians have sided with the enemy.

So I say to them:

You may well hold the levers of power at the moment, but we are on the rise and we are unstoppable. Do you seriously think you can do what you have done to your own people without repercussion?

You could stop this now if you chose to, by the simple expedient of putting the interests of your own people before the interests of Islam.

But you won’t do that will you? So you put us in an almost impossible position. If we do nothing we must accept our children and grandchildren will one day live under sharia law.

And if we do something, then it must by definition be revolutionary. But we did not start this. You did. Most of us would have been quite happy to mow the lawn, hold down a mundane job, and pay our taxes.

Yemeni Bomb was designed to explode on cargo plane - UK PM

The printer found in Dubai had a circuit board linked to a mobile phone card Prime Minister David Cameron says the device in a package sent from Yemen and found on a US-bound cargo plane was designed to go off on the aircraft.

But Mr Cameron said investigators could not yet be certain about when the device, intercepted at East Midlands Airport, was supposed to explode.

A second device containing explosives was found on a cargo plane in Dubai. The US suspects al-Qaeda involvement.

In Yemen, police have arrested a woman suspected of posting the packages.

She was detained in the capital, Sanaa, after being traced through a telephone number she had left with a cargo company, officials said.

The unnamed young woman, described as a medical student and the daughter of a petroleum engineer, was arrested along with her mother on the outskirts of the city, a security official told AFP news agency.

President Ali Abdullah Saleh said the US and the United Arab Emirates had provided Yemen with information that helped identify the woman and pledged that his country would continue fighting al-Qaeda "in co-operation with its partners".

"But we do not want anyone to interfere in Yemeni affairs by hunting down al-Qaeda," he added, as heavily armed troops patrolled Sanaa.

The Yemeni authorities also closed down the local offices of the US cargo firms UPS and FedEx, who had already suspended all shipments out of the country and pledged full co-operation with investigators.

US President Barack Obama's national security adviser, John Brennan, has phoned Mr Saleh to offer US help in fighting al-Qaeda, the White House said.

The US authorities have been impressed by the speed and determination the Yemeni authorities have shown in their response, the BBC's Jon Leyne reports from Cairo.

The explosive devices, which triggered security alerts in the US, UK and Middle East, were apparently both inserted in printer cartridges and placed in packages addressed to synagogues in the Chicago area.

Pentaerythritol tetranitrate (PETN) - an explosive favoured by the Yemeni-based militant group, al-Qaeda in the Arabian Peninsula (AQAP) - was discovered in the device intercepted in Dubai.

Mr Obama discussed the apparent terrorist plot with Mr Cameron by phone on Saturday, expressing his "appreciation for the professionalism of American and British services involved" in disrupting it, the White House said.

'Professional manner'

Later, Mr Cameron told reporters at his country residence, Chequers, that it was believed the explosive device intercepted at East Midlands Airport was "designed to go off on the aeroplane".

"There is no early evidence that it was meant to take place over British soil, but of course we cannot rule it out."

The prime minister said the authorities had immediately banned packages coming to or through the UK from Yemen, and would be "looking extremely carefully at any further steps we have to take".

UK Home Secretary Theresa May said the government did not believe the plotters would have known the location of the device when it was planned to explode.

While details of the device found in Britain were not released, photographs emerged on the US media of an ink toner cartridge covered in white powder and connected to a circuit board.

The British government's remarks suggest the authorities in both the UK and the US remain uncertain about the precise targets and, indeed, aim of this latest apparent plot, BBC defence and security correspondent Nick Childs reports.

Parcels could be seen stacked outside Sanaa airport on Saturday According to Dubai police, the explosives they found were also inside the toner cartridge of a printer, placed in a cardboard box containing English-language books and souvenirs.

The cartridge contained PETN and plastic explosives mixed with lead azide, they said. Lead azide is an explosive commonly used in detonators.

"The device was prepared in a professional manner and equipped with an electrical circuit linked to a mobile telephone [Sim] card concealed in the printer," the police said.

For US Homeland Security Secretary Janet Napolitano, the plot bore "all the hallmarks of al-Qaeda and in particular [AQAP]".

Unnamed US officials quoted by the Associated Press said al-Qaeda's explosives expert in Yemen, Ibrahim Hassan al-Asiri, was the likely suspect behind the bomb-making.

They said Mr Asiri had helped make the bomb used in the failed Detroit Christmas bomb attack and another PETN device used in a failed suicide attack against a top Saudi counter-terrorism official last year.

The White House has said Saudi Arabia provided information that helped identify the threat, while the UK's Daily Telegraph reported that an MI6 officer responsible for Yemen had received a tip-off.

Sting underscores Muslims' complex relationship with FBI

A sting operation over the course of months. Federal agents posing as al-Qaeda operatives. The text of the sacred Koran used to send coded messages.

When federal authorities arrested Farooque Ahmed, a 34-year-old Pakistani American, this week for an alleged plot to bomb Metrorail stations in Northern Virginia, Muslim groups in the area struggled with what to say publicly.

Should they condemn the man unequivocally and praise law enforcement? Orshould they wait?

As details of the arrest trickled out, many in the Muslim community avoided saying anything to outsiders, but instead quietly voiced concerns to one another about the tactics used.

The ambivalence highlights the complicated and often fraught relationship between law enforcement and Muslim Americans - an alliance some say has suffered especially in the last year with the slew of sting-like operations within their communities.

Increasingly, Muslims believe that even as they work with the FBI to combat terrorism, they are being spied upon by authorities.

The impact of those suspicions has been profound. Imams say longtime attendees at their mosque have suddenly grown reticent to welcome new strangers and new converts. Some Muslims say they catch themselves watching what they say and to whom, eyeing people in their own community as potential informants looking to lure them into arrest.

"The relationship with law enforcement right now is tense," said Ibrahim Hooper, spokesman for the Council on American-Islamic Relations, a group the FBI stopped working with last year on outreach efforts. "There's a sense of being under siege in many Muslim communities. People just assume there are agents or informants in their mosque now. It's a fact of life."

The FBI, however, emphasized that it does not investigate communities or mosques but individuals. "We are going to go within constitutional parameters where we need to go and talk to people we need to talk to," said spokeswoman Katherine Schweit. "But we are not looking to infiltrate anything other than individuals looking to harm others."

Since last year, more than 60 U.S. citizens have been charged or convicted in terrorism cases, federal officials say.

At Dar al-Hijrah, Imam Johari Abdul-Malik said his mosque works closely with law enforcement. But at the same time, he said, he believes there's been a chilling effect from the sting operations.

"When someone new walks into our mosque now, people don't talk to them," he said. "White converts have it worst. People just look at them and think, hmm, a little too straitlaced, a little suspicious, probably an agent. They just tell them to go talk to me."

Since the Sept. 11, 2001, terrorist attacks, local mosques have taken pains to show how willing they are to cooperate with authorities. They have invited the FBI to dinners, have given agents awards and now hold quarterly meetings with agents to communicate and build relationships. Those same FBI agents are also the ones they often call to report hate crimes, vandalism and other manifestations of Islamaphobia.

"We'd rather they come through the front door out in the open rather than the back door," Abdul-Malik said. "But it can sometimes be a one-way street. We tell them absolutely everything we know. But they don't tell us much of what they're doing in our own communities in return. Maybe it has to be like that when everything's under investigation, but there's an issue of building trust."

Local Muslims point to recent cases as examples of the thorny issues they face in dealing with the FBI. When the parents of five Washington-area Muslims realized their sons were missing last year, they reported it to federal authorities. In June, the men were convicted of terrorism charges in Pakistan.

One of the most significant rifts between authorities and Muslim communities involves a lawsuit filed against the FBI by a California man. The man says he worked as an informant for four years, roving through mosques in the Irvine area to look for extremists - assertions the FBI has not confirmed or denied.

Muslims have cited the case repeatedly as proof they are being spied upon by the same authorities they have tried for years to help. And shortly after the lawsuit was filed last year, a coalition of Muslim American groups threatened to cut off contact with the FBI for what it called "McCarthy-era" tactics.

"The suggestion that we send agents just roaming through mosques is simply not true," said Schweit. "And First Amendment rights here are absolutely being protected. If a conversation doesn't involve criminal activity, what chilling effect would there be?"

Some local Muslims, however, say the fallout of informants and sting operations has already trickled into their daily life.

Miriam Abdrahmaan, who runs a Muslim funeral service in Chantilly, said: "I wish I could just be myself. We have freedom of speech in this country, but we're not always free to say what we think. We have to watch who we talk to and what we say. It's not cool."

I Would like to ask Miriam and all the other Muslims out there who are afraid someone might hear what they have to say. Could it be that Miriam and most of the others would be saying things about Americans that we Americans allready know they are thinking and saying. They really hate what America stands for. They enjoy freedom of speach but when we Americans voice our opinions that Muslims don't want to hear, they cry Islamophobia. They want to silence us from voicing the truth. That truth being that Muslims can't coexist in our society. They expect us Americans to give in to their demands. Well Im sorry but this is America, and if Muslims want to live here, they best learn to live under the rules of our forefathers, and not some pedophile named Muhammad. Muslims want Sharia law here in America. Sorry Muhammad, this isn't europe. Americans will resist once they understand what evil you want to impose upon us all. Pack you prayer rug and get the hell out of my country if your not willing to obide by the laws of the Constitution.

The responsible organizations have undertaken much – the Christians on the Side of Israel (non-profit), the “I like Israel” association, the Frankfurt German-Israeli Society, and the operators of the Internet portal “Honestly Concerned.” In various podiums, politicians, authors and representatives of Jewish and Christian organizations will have discussions about “Israel, Islamism and Western Policy,” about “Antisemitism and Antiisraelism,” as well as “Iran and Terror.” Welcoming addresses from representatives of the city of Frankfurt and the state of Hesse, from the Central Council as well as the Jewish communities in Berlin and Frankfurt will start the event.

Besides politics, the literary and musical entertainment will also play a role – the organizers have invited the young Israeli star Eden Haham. Roman Kuperschmidt and his clarinet will accompany the serious to lighthearted congressional topics with song and dance. Arye Sharuz Shalicar and Ralph Giordano will read interesting things from their books.

Cargo plane bomb alert: explosive devices 'designed to harm US synagogues'

An international terrorist alert over a possible al-Qaeda parcel bomb threat to synagogues has been triggered following the discovery of a package containing explosive material at a British airport.

 The suspected plot was uncovered by MI6 after a tip-off to one of its officers responsible for Yemen, which has become a key battleground in the fight against Islamic terrorists.

On Friday, airports in the United States were on high alert after parcels containing explosive material, and addressed to synagogues in Chicago, were discovered on cargo aircraft at East Midlands airport and in Dubai.

 Barack Obama, the US President, confirmed the packages sent from Yemen and intercepted in Dubai and the East Midlands had contained explosive material.

The US President said the devices represented a "credible terrorist threat against our country".

John Brennan, Mr Obama's Deputy National Security Adviser for Homeland Security and Counterterrorism, said the "birdbox" packages were "designed to do harm".

"Clearly from this initial analysis the materials that were found in the device that was uncovered were intended to do harm," he told reporters at the White House.

Asked whether Anwar al-Awlaki, a radical US-Yemeni cleric, was suspected of being involved, Mr Brennan said all people with known links to al-Qaeda in the country were being discussed.

The "sinister" parcel at East Midlands, contained in a UPS container, comprised what police described as a "manipulated" computer printer cartridge, which was covered in white powder and had wires protruding from it.

The device initially tested negative for traces of explosives but it was understood that a further search uncovered a second suspicious package containing a "cleverly hidden" device in a printer, which included a mobile phone as one of its components.

Officials in the US last night said that early indications were that the packages contained PETN, the chemical used by Umar Farouk Abdulmutallab in the failed Christmas Day plane bombing in Detroit.

The white-powdered substance is commonly used in detonation material for industrial explosions. It was also part of the device used in 2001 by Richard Reid, the "shoe-bomber" who failed to blow up a plane bound for Miami.

There were reports that up to 20 similar suspect packages had been sent from Sana'a, the capital of Yemen, targeting synagogues in the US.

Mr Obama said: "Initial examination of these packages has determined that they do apparently contain explosive material."

US officials were investigating three theories: that the packages contained viable devices; that they were part of a dry run for a parcel bomb plot; or that they were a hoax designed to cause panic in the US before midterm elections. Mr Brennan said that a "traditional dry-run" would not ordinarily involve the use of explosive materials.

Mr Obama ordered a security clampdown across the US after the discovery of the parcel at East Midlands. Aircraft were grounded in Philadelphia and New York.

The alert increased the focus on the threat emanating from Yemen, which was where Umar Farouk Abdulmutallab, who was caught trying to detonate a bomb hidden in his underwear on a flight to Detroit last Christmas, said he had been trained.

US officials said the Yemeni-based al-Qaeda in the Arabian Peninsula (AQAP) would be at the top of the list of suspects if any terrorism links were confirmed. Mr Brennan described AQAP as "the most active operational franchise" of the terrorist group.

Theresa May, the Home Secretary, said all direct flights from Yemen to Britain had been grounded. Sir John Sawers, the head of MI6, pinpointed the country as a security concern in his first public speech on Thursday.

There is particular concern over al-Awlaki, an al-Qaeda leader and US national who is based in Yemen and uses the internet to broadcast propaganda and terrorist instruction in fluent English.

Sermons by al-Awlaki, who has been described as the "bin Laden of the internet", were attended by some of the September 11 hijackers.

Faisal Shahzad, who admitted to attempting to detonate a car bomb in New York's Times Square earlier this year, said he had been inspired by al-Awlaki,

Sources told The Daily Telegraph that MI6 began the security operation after receiving information from a source in Yemen. Following the tip-off, Leicester­shire police found the package on a cargo plane at East Midlands airport at about 3.30am.

Scotland Yard's counter terrorism command, which took over the investigation, confirmed that several items had been taken away for analysis.

Mrs May said there was nothing to suggest that any location in Britain was being targeted. "A suspect package was discovered during a search of a cargo flight at East Midlands airport," she said. "The package originated in Yemen and was addressed to a US destination.

"We are considering what steps need to be put in place regarding security of freight originating from Yemen. For security reasons, there are currently no direct flights from Yemen to the UK."

The parcels appear to have been shipped by UPS and FedEx. Using the tracking numbers of all packages sent in a consignment from Sanna, which had been split as it made its way to the US, authorities began checking all other possible suspect packages.

Two UPS jets in Philadelphia and a third jet in Newark, New Jersey, that had flown in from Germany and France were moved away from terminal buildings. No explosives were found.

In Brooklyn, New York, police examined a package from a UPS lorry, but found nothing suspicious.
A spokesman for the Jewish Federation of Chicago said it was alerted early yesterday and had advised local synagogues to take security precautions.

A White House spokesman said: “Intelligence and law enforcement agencies discovered potential suspicious packages on two planes in transit to the United States. “Based on close co-operation among US government agencies and with our foreign allies and partners, authorities were able to identify and examine two suspicious packages, one in London and one in Dubai.

“Both of these packages originated from Yemen. As a result of security precautions triggered by this threat, the additional measures were taken regarding the flights at Newark Liberty and ­Philadelphia International Airports.”

There was a dispute over airline security earlier this week when senior figures in the industry, including Martin Broughton, the chairman of British Airways, said Britain should stop “kowtowing” to excessive US security demands.

The latest developments will only increase security measures, especially surrounding cargo planes. The threat level in Britain was raised from substantial to “severe” in March partly as a result of an increased threat from Yemen.

Don't worry, Muslim Obama and John Brennan, another Muslim lover are on the job protecting Americans. Just don't call this another threat by Muslim extremist. Al-qaida is fine but then isn't Al-qaida Muslims?

Man arrested over 'terror plot' to bomb Washington DC trains

A naturalised American citizen born in Pakistan has been arrested over bomb plots on railway stations in the US capital that could have caused mass casualties, the FBI said.

The public was never in danger because FBI agents were aware of Ahmed's activities and monitored him throughout, the agency said. And the people that Ahmed thought were al-Qaeda operatives were actually individuals who "worked on behalf of the government in this matter," according to a federal law enforcement official who requested anonymity.

Ahmed faces 50 years in prison for charges of attempting to provide material support to a designated terrorist organisation, collecting information to assist in planning a terrorist attack on a transit facility, and attempting to provide material support to carry out multiple bombings to cause mass casualties.

According to the indictment, Ahmed took video footage of four northern Virginia subway stations, two of them near the Pentagon, and monitored the security at a hotel in Washington.

In a series of meetings at hotels in northern Virginia, Ahmed provided these videos and diagrams of two of the stations to someone he believed was part of a terrorist organisation, and also said he wanted to donate $10,000 (£6,300) to help the overseas fight and collect donations in a way that would not raise red flags.

U.S. Attorney Neil MacBride said in a statement that it was "chilling that a man from Ashburn is accused of casing rail stations with the goal of killing as many Metro (subway) riders as possible through simultaneous bomb attacks".

Andrew Ames, a spokesman for the FBI Washington field office, declined to comment on how authorities first learned about Ahmed.

During a brief appearance in federal court in Alexandria on Wednesday, Ahmed did not enter a plea and was ordered to be held without bond. He told U.S. Magistrate Judge John Anderson he could not afford to hire a lawyer. Prosecutors said they planned to use some classified information as evidence in the case.

Since the September 11 attacks, the US authorities have worried about another attack on American soil.

Last week, a Jordanian national was sentenced to 24 years in prison for attempting to blow up a Dallas skyscraper. Earlier this month, Pakistani-born American Faisal Shahzad was sentenced to life in prison for trying to set off a car bomb in New York's Times Square.

Sixteen-year-old Mohammad Salaam, a student of Class IX, had met Tehreek-e-Taliban leader Zahir Shah at one of these schools.

"Shah said that becoming a suicide bomber was my ticket to heaven, and on the Day of Judgement I would have nothing to worry about," Salaam said.

Later, Salaam discussed this with another TTP leader, Rauf, who also encouraged him to become a suicide bomber.

The teenager then made up his mind to go to Afghanistan and to blow himself up there. He told this to another leader Sher Rehman.

Rehman told Salaam that he didn't have any contacts in Afghanistan but that there were "ample opportunities" in Pakistan to become a suicide bomber.

Salaam said: "Sher Rehman said we do not know the fate of those who will be killed in my attack, but one thing was certain: I will definitely go to heaven."

The young man was encouraged to go to strife-hit Waziristan where he would be imparted further training.

"My meetings with Rehman and other leaders were usually at night, and never in public gatherings.

"Rehman told me that if I disclose my relations with them, they will behead my family and me. After getting caught, I have realised that I was engaged in vice," the teenager said.

During Fox News Sunday's online "Panel Plus" segment, Juan Williams made the case against building the 13-story Islamic center a couple blocks from Ground Zero. Although the imam who owns the land has a right to do what he wants with his own property, Williams said, as a matter of decency the imam shouldn't build the mosque.

Williams said that the proposed mosque and the imam's actions are "a thumb in the eye to so many people who lost their lives and went through the trauma there. It's not promoting dialogue or understanding. In fact, it's polarizing. So it's not achieving his stated goal. And for that reason, I just think he's wrong to do it."

Williams's comments on the Ground Zero Mosque come a couple days after the Anti-Defamation League declared that "building an Islamic Center in the shadow of the World Trade Center will cause some victims more pain – unnecessarily – and that is not right."

Its clear now why Williams was fired from NPR. Not so much for his comments about his feelings on a plane with Muslims, but for his earlier statement that he opposed the Ground Zero Mosque. CAIR had to bee in an uproar over Williams statements, and the plane comments was the last straw for CAIR.  They pressured NPR the liberal network funded heavily by Socialist George Soros. That combination got Williams canned from his NPR spot. Thank goodness that Fox Network isn't about to be bullied by the likes of CAIR and other Muslims organizations.

At the end of last week's letter on the whole mortgage foreclosure mess, I wrote:

"All those subprime and Alt-A mortgages written in the middle of the last decade? They were packaged and sold in securities. They have had huge losses. But those securities had representations and warranties about what was in them. And guess what, the investment banks may have stretched credibility about those warranties. There is the real probability that the investment banks that sold them are going to have to buy them back. We are talking the potential for multiple hundreds of billions of dollars in losses that will have to be eaten by the large investment banks. We will get into details, but it could create the potential for some banks to have real problems."

Real problems indeed. Seems the Fed, PIMCO, and others are suing Countrywide over this very topic. We will go into detail later in this week's letter, covering the massive fraud involved in the sale of mortgage-backed securities. Frankly, this is scandalous. It is almost too much to contemplate, but I will make an effort.

But first, let me acknowledge the huge deluge of emails I got over last week's letter, the most I can ever remember. I thought about just making this week's letter a response to many of them, but decided I needed to go ahead and finish the topic at hand. Maybe another time. As a side note, I quoted a letter that came to me anonymously via David Kotok. I said if I found out who wrote it, I would give them credit. It was originally written by Gonzalo Liro,  at

Many of you wrote to point out that his argument about the tracking of title was not correct, but others pointed out many other issues as well. This is one of the most complex problems we face, and I got a lot of good information from readers. It just makes me wish I had our new web site finished so you could avail yourselves of the wisdom among my readers. We are close, down to final changes. And now, on to today's letter.

They Knew What They Were Selling

It's hard to know where to start. There is just so much here. So let's begin with testimony from Mr. Richard Bowen, former senior vice-president and business chief underwriter with CitiMortgage Inc. This was given to the Financial Crisis Inquiry Commission Hearing on Subprime Lending andnd Securitization andnd Government Sponsored Enterprises. I am going to excerpt from his testimony, but you can read the whole thing (if you have a strong stomach) at

"The delegated flow channel purchased approximately $50 billion of prime mortgages annually. These mortgages were not underwriten by us before they were purchased. My Quality Assurance area was responsible for underwriting a small sample of the files post-purchase to ensure credit quality was maintained.

"These mortgages were sold to Fannie Mae, Freddie Mac [We will come back to this - JM] and other investors. Although we did not underwrite these mortgages, Citi did rep and warrant to the investors that the mortgages were underwritten to Citi credit guidelines.

"In mid-2006 I discovered that over 60% of these mortgages purchased and sold were defective. Because Citi had given reps and warrants to the investors that the mortgages were not defective, the investors could force Citi to repurchase many billions of dollars of these defective assets. This situation represented a large potential risk to the shareholders of Citigroup.

"I started issuing warnings in June of 2006 and attempted to get management to address these critical risk issues. These warnings continued through 2007 and went to all levels of the Consumer Lending Group.

"We continued to purchase and sell to investors even larger volumes of mortgages through 2007. And defective mortgages increased during 2007 to over 80% of production."

Mr. Bowen was no young kid. He had 35 years of experience. He was the guy they hired to pay attention to the risks, and they ignored him. How could a senior manager not get such an email and not notify his boss, if only to protect his own ass? They had to have known what they were selling all the way up and down the ladder. But the music was playing and Chuck Prince said to dance and rake in the profits (and bonuses!). More from his testimony:

"Beginning in 2006 I issued many warnings to management concerning these practices, and specifically objected to the purchase of many identified pools. I believed that these practices exposed Citi to substantial risk of loss.

Warning to Mr. Robert Rubin and Management

"On November 3, 2007, I sent an email to Mr. Robert Rubin and three other members of Corporate Management... In this email I outlined the business practices that I had witnessed and attempted to address. I specifically warned about the extreme risks that existed within the Consumer Lending Group. And I warned that there were 'resulting significant but possibly unrecognized financial losses existing within Citigroup.'"

And now taxpayers own 75% of Citi, and our losses to them are huge. They are going to get worse, as we will see.

Now let's turn to the testimony of Keith Johnson, who worked for various mortgage companies and in 2006 became the president and chief operating officer of Clayton Holdings, the largest residential loan due diligence and securitization surveillance company in the United States and Europe. This is testimony he gave before the Financial Crisis Inquiry Commission. Part of the testimony is by his associate Vicki Beal, senior vice-president of Clayton. The transcript is some 277 pages long, so let me summarize.

Investment banks would come to Clayton and give then roughly 10% of the mortgages that they intended to buy and put into a security. Clayton rated them on whether the documentation was what it was supposed to be, not as to whether they thought it was a good loan. Still, 46% of the loans did not have proper documentation (out of a pool of 9 million loans) and 28% had what was determined to be level 3 disqualifications that simply had no mitigating circumstances. Understand, these were loans that were already written, and there was no effort to check the facts, just the documentation.

And ultimately 11% of these loans (39% of the level 3's) were put back in by the investment bank. And what happened to the loans that were rejected? (This might require an adult beverage and a few expletives deleted.)

Popping Through

They were put back into another pool, where again only 10% of the loans were examined. Quoting from the testimony:

"MR. JOHNSON: I think it goes to the 'three strikes, you're out' rule.

"CHAIRMAN ANGELIDES: So this was a case of - okay, three strikes.

"MR. JOHNSON: I've heard that even used. Try it once, try it twice, try it three times, and if you can't get it out, then put -

"CHAIRMAN ANGELIDES: Well, the odds are pretty good if you are sampling 5 to 10 percent that you'll pop through. When you said the good, the bad, the ugly, the ugly will pop through."

Yes, you read that right. If a loan was rejected a second time, it went back into yet another pool for a third try. The odds of coming up three times, when only 5 or 10 percent are sampled? About 1 in a thousand. Popping through, indeed.

Clayton presented their data to the ratings agencies, investment banks, and others in the industry. They were frustrated that no one was really paying attention or taking heed of their warnings.

Here is what Shahien Nasiripour, the business reporter for the Huffington Post, wrote (his emphasis). For those interested, the entire article is worth reading.


"Johnson told the crisis panel that he thought the firm's findings should have been disclosed to investors during this period. He added that he saw one European deal mention it, but nothing else.

"The firm's findings could have been 'material,' Johnson said, using a legal adjective that could determine cause or affect a judgment.

"It's unclear whether the firms ended up buying all of those loans, or whether Wall Street securitized them all and sold them off to investors.

"'Clayton generally does not know which or how many loans the client ultimately purchases,' Beal said. That likely will be the subject of litigation and investigations going forward.

"'This should have a phenomenal effect legally, both in terms of the ability of investors to force put-backs and to sue for fraud,' said Joshua Rosner, managing director at independent research consultancy Graham Fisher & Co.

"'Original buyers of these securities could sue for fraud; distressed investors, who buy assets on the cheap, could force issuers to take back the mortgages and swallow the losses.

"'I don't think people are really thinking about this,' Rosner said. 'This is not just errors and omissions - this appears to be fraud, especially if there is evidence to demonstrate that they went back and used the due diligence reports to justify paying lower prices for the loans, and did not inform the investors of that."

"Beal testified that Clayton's clients use the firm's reports to 'negotiate better prices on pools of loans they are considering for purchase,' among other uses.

"Nearly $1.7 trillion in securities backed by mortgages not guaranteed by the government were sold to investors during those 18 months, according to Inside Mortgage Finance. Wall Street banks sold much of that. At its peak, the amount of outstanding so-called non-agency mortgage securities reached $2.3 trillion in June 2007, according to data compiled by Bloomberg. Less than $1.4 trillion remain as investors refused to buy new issuance and the mortgages underpinning existing securities were either paid off or written off as losses, Bloomberg data show.

"The potential for liability on the part of the issuer 'probably does give an investor more grounds for a lawsuit than they would ordinarily have', Cecala said. 'Generally, to go after an issuer you really have to prove that they knowingly did something wrong. This certainly seems to lend credibility to that argument.'

"'This appears to be a massive fraud perpetrated on the investing public on a scale never before seen,' Rosner added."

It's Time for Some Putback Payback

Investment banks large and small originated a lot of subprime garbage in the 2005-2007 era. This week PIMCO, Black Rock, Freddie Mac, the New York Fed, and - what I think is key and no one has picked up on - Neuberger Berman Europe, Ltd., an investment manager to a managed-account client, came together and sued Countrywide for not putting back bad mortgages to its parent, Bank of America. This is the first of what will be a series of suits aimed at getting control of the portfolio and peeking into the mortgages. (Text of lawsuit at:

Basically, if buyers of 25% or more of a mortgage-backed security can come together, they have standing to sue the mortgage servicer to do its duty to the investors and make putbacks of bad mortgages, and if they fail to do so the plaintiffs can take control of the process and take the issuer to court directly (that's a very simplistic description but roughly accurate).

There are two key take-aways. First, note that a European entity is involved. Hundreds of billions of dollars of this junk was sold to European banks and funds. And these guys get together at conferences (sometimes they even invite me to speak). So Helmut will be talking to Lars who will talk to Jean Pierre and they will realize they all own some of this junk. They will be watching with very real interest to see how the big boys at PIMCO and Black Rock and the New York Fed fare in their efforts. And then you can count on them all piling on (more later on this).

Second, little noticed this week was the fact that The Litigation Daily wrote that Philippe Selendy of Quinn Emanuel Urquhart & Sullivan has been retained by the Federal Housing Finance Agency (FHFA), which oversees Fannie Mae and Freddie Mac, to investigate billions of dollars in potential claims against banks and other issuers of mortgage-backed securities.

Who? Not on your celebrity list? Just wait. He will soon be getting the best tables everywhere. He and his firm are the guys representing MBIA in all their cases against Countrywide and Merrill Lynch. And they are kicking ass. Slowly to be sure, but very steady. That means Fannie and Freddie are getting ready to get serious.

They were sold well over $227 billion of the subprime garbage issued in 2006 and 2007. And the bad stuff started before then. But they have one advantage that the guys at PIMCO, et al. don't have: they (or actually the FHFA) are a federal agency. That means they have subpoena power. The agency has sent 64 subpoenas to issuers of mortgage-backed securities, and although they have not said who they went to, they obviously include almost everyone and clearly all the big players. (They couldn't have ignored Goldman, could they? Naah. Too obvious.)

From American (I know, this website is probably already on your favorites list, but for those souls who actually have a life I provide the text):

"Through those subpoenas, the agency could gain access to the loan files for the mortgages that backed the securities it bought and thus establish whether the mortgages were what the issuers represented them to be in securities contracts. According to the Journal, the difficulty of obtaining loan files has been a big obstacle for investors trying to force issuers to repurchase bonds.

"If the FHFA were to decide down the road to initiate litigation, it would still have to have the support of a percentage (usually 25 percent) of its fellow bondholders for each issue. But given what the agency and its Quinn lawyers will be able to see before bringing suit, it probably won't be too hard to get other investors on the bandwagon."


It is tough not to jump to the conclusion, but we need one more piece of the puzzle before we get there.

The Worst Deal of the Decade?

Arguably Bank of America had Merrill shoved down their throats, but no one can say that about the acquisition of Countrywide. And Countrywide could end up costing BAC $50 billion or more in losses. That may prove to be a serious candidate for worst deal of the decade. (Although WAMU is a leading candidate too!)

Let's look at a report by Branch Hill Capital, a hedge fund out of San Francisco. And before we start on it, let me point out they are short Bank of America. You can see the full PowerPoint at

(And let me say a big thanks to the author of the report, Manal Mehta, for all the background material he sent me and his help with this week's letter. It helped make it a lot better. Of course, any erroneous conclusions or outrageous statements are all mine.)

First, they point out that the potential size of Bank of America's (BAC) liabilities is $74 billion (with a B). And that is just for Countrywide. That does not include Merrill, which is also large. Against that they have set aside $3.9 billion. You can count on more suits than just the PIMCO, et al. mentioned above.

In the MBIA case, the judge has ruled that the suit can proceed even though BAC has denied responsibility. Although on appeal, this is high-stakes poker. Countrywide originated over $1.4 trillion of mortgages in 2005-2007. MBIA alleges that over 90% of the defaulted or delinquent loans in the Countrywide securitizations show material discrepancies. Care to take the under in the over/under bet on that?

Further to the case on BAC, Merrill was the largest originator of subprime CDOs during the housing boom, for another $120 billion, along with about $255 billion of residential mortgage-backed securities.

And then there are all those CDOs (collaterized debt obligations). Merrill did a lot of those that went sour. This deserves it own leter, but a gentleman named Wing Chau went from making $140k a year to $25 million in just a few years, putting together CDOs from Merrill, some of which were completely bankrupt in just six months.

Countrywide has already settled with the New York pension funds for $624 million, one of the largest securities fraud settlements in US history. And the line is growing longer.

Of course, BAC CEO Brian Moynihan denied this week that there is a problem. Let's look at Moynihan's statements at the last earnings call and compare them to what the judge in the case said earlier. Moynihan:

"... we execute repurchases on a loan by loan basis... And as we learn more, and again, our perspective on this - we're going to be quite diligent as I said in defending the interest of our shareholders. This really gets down to a loan-by-loan determination and we have, we believe, the resources to deploy against that kind of a review."

Back in June the judge on the case (a Judge Bransten) said (from the transcript):

"I think that it makes all the sense in the world that you can use a sample to prove the case because otherwise I can't imagine a jury listening to 386 thousand cases. Even if you have that available, nevertheless you are not going to present that to a jury or even to a judge. I'm patient but not that patient. So therefore it is going to be a sample in the end..."

OK, let me get this straight, Brian. Your company committed fraud, with robosignings and all the rest, and you won't man up and take responsibility? You and your lawyers want to thrash this out, case by case, fighting a trench-warfare, rear-guard action? Well I'm afraid that's not going to work out for you. There are so many examples of Countrywide outright fraud that it is going to be hard to convince a jury that BAC is not on the hook. Will it take years? Of course.

You can read the PowerPoint for details. Bottom line: BAC is probably liable for putbacks that could total over a hundred billion. And that is just BAC.

Think Citi. And any of the scores of mortgage originators and investment banks. There were a couple of trillion dollars in these securitizations issued. Plus how many hundred of billions of second-lien loans? And can we forget CDOs? And CDOs squared?

And let's not forget all those completely synthetic CDOs that were written at the height of the mania. Most of it AAA, of course. Frankly, anyone stupid enough to buy a synthetic CDO should lose their money, but that is not what the courts will base their decision on. It is all about representations and warranties. And maybe a little fraud.

I picked on BAC because that is the analysis I saw. But it could be any of dozens of banks. Look at this list from the Branch Hill PowerPoint.

Could we see a hundred billion in losses to the major banks? In my opinion we will for sure, over time. $200 billion? Probably. $300 billion? Maybe. $400 billion? It depends on how organized the investors in the securities get and what gets settled out of court. Out of a few trillion dollars in securitizations? It's anybody's guess. I just made mine.

But let's not forget the $227 billion sold to Fannie and Freddie. Taxpayers are on the hook for $300-400 billion in losses. Those putbacks could save us a lot. Will this threaten the viability of some banks? Maybe. But most will survive. BAC made $3 billion last quarter. A steep yield curve (with the help of the Fed) can cure a lot of evils. But it will absorb the profits of a lot of banks for a long time.

And that of course, will come back to haunt the rest of us as banks have to raise more capital and get more conservative.

Anyone who owns stocks in banks with relatively large MBS exposure is not investing, they are gambling that the losses will not be more than management is telling them. There will be no bailouts (at least I hope not) this time around. Fool me once, shame on you; fool me twice, shame on me. There will be little sympathy for shareholders or bondholders this time, if it comes to that.

One more sad point. The FDIC (read taxpayers) is liable for some of this, as they took over some of these institutions. It just keeps on coming.

Final rant. If you were part of a group that knowingly created or sold flawed and fraudulent mortgage-backed securities to pensions and insurance companies and took home tens of millions in bonuses, up and down the management chain, maybe you should consider moving yourself and your money to a country that does not honor US extradition, because my guess is that, as all this comes out, you may have to hire some very expensive lawyers and get measured for pinstripes.

And the Mozilo agreement was a sham. Sigh. That would be the equivalent of fining me $10,000 and letting me keep my tanning bed. I don't have the space to go into the fraud at Countrywide, but their internal documents show they all knew what was going on.

Keith Ellison's fatwa

Minnesota Fifth District Rep. Keith Ellison made his name as the first Muslim elected to Congress. It was therefore all but obligatory for him to weigh in on the firing of Juan Williams from NPR as a result of Williams's expression of his feelings on Fox News about seeing air passengers dressed in "Muslim garb," as he did last week on Ed Schultz's MSNBC show.

It's always illuminating to hear the deep thoughts of Keith Ellison on matters of public concern. We still await the enterprising journalist who will ask Ellison which branch of Islam it is that comports with the tenets of the Democratic agenda on the equality of women, abortion, gay rights and all the rest. Then we might learn something from him that we don't know.

Incidentally, Ellison used to hang with the gangbanging Minneapolis cop killer Sharif Willis. Now he hangs with the likes of Schultz, an altogether better class of thug. In his conversation with Schultz, Ellison announced he felt like taking Williams's books (referred to in in the singular as "that stuff") off the shelf "and putting it in the garbage."

Schultz elicited from Ellison the fevered charge that "Juan Williams contributes to profiling and harassing Americans." He doubts Williams's integrity -- this from a guy who predicated his first congressional campaign on three easily demonstrable lies.

Given the profile of the perpetrators of 9/11, Ellison makes the point that Williams's reaction to passengers in "Muslim garb" is misguided. Is Ellison chiding Williams for failing to observe that the rational fear would be focused on Muslims who blend in? Muslims like Keith Ellison? Let's consider the point duly noted. While Ellison's point has superficial plausibility, however, one should also consider the uses of "Muslim garb" in concealing the explosive vest that has proved so popular among Muslim terrorists.

It should be noted that Ellison lurked in the background of the November 2006 incident involving the flying imams at the Minneapolis-St. Paul International Airport. The whole point of the lawsuit brought by the flying imams was to disable law enforcement from acting on the justifiable concerns of ordinary citizens about ostentatious Muslims behaving in a manner that would cause rational concern.

The flying imams were removed from the aircraft and interrogated while the USAirways flight went on its way. USAirways and the law enforcement defendants in the flying imams' lawsuit paid an undisclosed but tidy sum to the flying imams to settle their lawsuit. The flying imams prevailed; the next time around, it will be the imams who fly and the other passengers who stay behind.
